Agrarian Reform

Agrarian Reform is one of the duties and functions of the Land Bank Authority as mandated in Government Regulation (PP) Number 64 of 2021. The Land Bank Authority is obliged to provide at least 30 percent of the Land Bank Authority’s HPL for Agrarian Reform.

Communities who are the subject of Agrarian Reform will get Usage Rights above the HPL of the Land Bank Authority for 10 years and will be given a Certificate of Ownership Rights (SHM) if they have been put to good use.

The Land Bank prepares the land, subject verification is carried out by the Agrarian Reform Task Force (GTRA) chaired by the Regent/Mayor.

Program Scheme

1. Guarantee the availability of land of at least 30% of state land designated for the Land Bank

  • Preparation of Land Bank Agency HPL Master Plan/Masterplan
  • Determination of the RA location in the Master Plan by the Head of the Land Bank Agency
  • Proposing TORA allocation to the Minister of ATR/BPN
 

2. RA Program - Redistribution of land above the HPL of the Land Bank Agency

  • Determination of TORA by the Minister of ATR/BPN
  • Submission of Redistribution Object determination to GTRA
 

3. Agrarian Reform Task Force Team

  • List of Subjects and Objects
  • Determination of plot and land locations according to the RA site plan for each subject
  • As a witness in the Land Utilization Agreement
 

4. Land Utilization Agreement with RA Subject

 

5. Granting a term of Use Rights above the HPL of the Land Bank Agency for RA Subjects (at least 10 years)

 

6. Legalization of Use Rights for RA Objects by the Ministry of ATR/BPN

 

7. Supervision and control over the use or utilization of land above HPL

 

8. Legalization of Asset Ownership Rights

 

9. Issuance of Property Rights for RA Subjects if utilized properly after 10 years

1. Redistribution of land above Land Bank Agency HPL, RS Site Plan: 

  • Agricultural Plots, Plantations, Livestock, Fisheries
  • Residential Plots
 

2. Land Utilization Agreement with RA Subject

 

3. Granting a term of Use Rights above the HPL of the Land Bank Agency for RA Subjects (at least 10 years)

 

4. Legalization of Use Rights for RA Objects by the Ministry of ATR/BPN

 

5. Supervision and control over the use or utilization of land above HPL

 

6. Legalization of Asset Ownership Rights

 

7. Issuance of Property Rights for RA Subjects if utilized properly after 10 years

1. Providing recommendations for Issuance of Ownership Rights and Disposal of part of HPL land
2. Issuance of Property Rights for RA Subjects if utilized properly after 10 years
